# Huurwoning en Scheiding: Wie Mag Blijven?

Wie mag in de gehuurde woning blijven en hoe regelt u dit met de verhuurder?

## Gezamenlijk Huurcontract

Als beide partners het huurcontract ondertekenden, zijn beiden hoofdelijk aansprakelijk voor de huur. Bij scheiding moet worden beslist wie blijft. De verhuurder moet akkoord gaan met wijziging van het contract.

## Overdracht Huurrecht

De rechter kan beslissen dat één partner de woning verlaat en de andere het huurrecht voortzet. De verhuurder is hieraan gebonden bij rechterlijke beslissing. De vertrekkende partner wordt ontheven van verdere huurverplichtingen.

## Sociale Huurwoning

Bij sociale huisvesting gelden specifieke regels. Het inkomen van de blijvende partner wordt herbeoordeeld. Mogelijk moet het huurcontract worden aangepast aan de nieuwe gezinssituatie.
