# In het Buitenland Getrouwd: Scheiden in België

Hoe scheidt u in België als u in het buitenland bent getrouwd?

## Erkenning Buitenlands Huwelijk

Een in het buitenland gesloten huwelijk wordt in België erkend als het voldoet aan de vormvereisten van het land waar het werd gesloten en niet strijdig is met de Belgische openbare orde. Het huwelijk moet zijn ingeschreven in de Belgische registers.

## Bevoegde Rechtbank

Als u in België woont, is de Belgische rechtbank bevoegd om de scheiding uit te spreken, ongeacht waar u bent getrouwd. De verblijfplaats, niet de huwelijksplaats, bepaalt de bevoegdheid.

## Toepasselijk Recht

Welk recht wordt toegepast op uw scheiding (Belgisch of buitenlands) hangt af van uw nationaliteit(en) en gewoonlijke verblijfplaats. In veel gevallen wordt Belgisch recht toegepast als beide partners in België wonen.
