# Scheiding bij Dubbele Nationaliteit: Welk Recht Geldt?

Welk recht is van toepassing bij scheiding wanneer u dubbele nationaliteit heeft?

## Bepalen van Toepasselijk Recht

Bij dubbele nationaliteit wordt gekeken naar de gewoonlijke verblijfplaats, niet automatisch naar nationaliteit. Als beide partners in België wonen, wordt doorgaans Belgisch recht toegepast, ongeacht hun nationaliteit(en).

## Rechtskeuze

Binnen de EU kunnen echtparen een rechtskeuze maken: u spreekt af welk recht van toepassing is op een eventuele scheiding. Dit moet schriftelijk worden vastgelegd, bijvoorbeeld in een huwelijkscontract.

## Forum Shopping

Soms proberen partijen te scheiden in het land met de voor hen gunstigste regels ('forum shopping'). Belgische rechtbanken controleren of zij bevoegd zijn volgens Europese regels en of de rechtskeuze geldig is.
