Grensoverschrijdende scheiding tussen België en Nederland: welk recht is van toepassing?

## Bevoegde Rechtbank Bepalen

De Europese Brussel IIter Verordening bepaalt welke rechtbank bevoegd is. Dit is meestal de rechtbank van de laatste gemeenschappelijke woonplaats of waar één van de echtgenoten nu woont.

## Toepasselijk Recht

Het toepasselijk recht op de scheiding zelf is het recht van de gewone verblijfplaats. Voor vermogensverdeling geldt vaak het recht waaronder u getrouwd bent, tenzij een rechtskeuze is gemaakt.

## Erkenning van Vonnissen

Belgische en Nederlandse echtscheidingsvonnissen worden automatisch wederzijds erkend binnen de EU. Geen exequaturprocedure is nodig. Voor alimentatie gelden specifieke Europese regels.
