# Alimentatie Herberekenen bij Gewijzigde Omstandigheden

Wanneer en hoe kunt u alimentatie laten herberekenen bij gewijzigde omstandigheden?

## Gronden voor Herberekening

Alimentatie kan worden herzien bij wezenlijke wijziging van omstandigheden: inkomensverlies door ontslag, nieuwe gezinssituatie, stijgende kosten kinderen, of gewijzigde verblijfsregeling. De wijziging moet substantieel en blijvend zijn om herziening te rechtvaardigen.

## Procedure tot Wijziging

U dient een verzoekschrift in bij de familierechtbank. Leg bewijs voor van de gewijzigde omstandigheden: loonfiches, ontslagbrief, nieuwe gezinssamenstelling. De rechter beoordeelt of herziening gerechtvaardigd is.

## Automatische Indexatie

Los van herberekening wordt alimentatie om de twaalf maanden geïndexeerd volgens het indexcijfer van de consumptieprijzen (art. 203quater §1 oud BW). Dit gebeurt van rechtswege, met als basisindex die van de maand vóór het vonnis. Indexatie is geen herberekening maar aanpassing aan levensduurte.
